How India decides the salaries of chief ministers and legislators

Each state has the power to decide its salary structure for its Chief Minister and MPs as per Article 164(5) of the Constitution of India

On Tuesday, the Karnataka Legislative Assembly passed the Karnataka Ministers’ Salaries and Allowances (Amendment) Bill 2022 and the Karnataka Legislature Salaries, Pensions and Allowances Bill 2022. (amendment) without any discussion.

The passage of these two pieces of legislation increases the salaries and allowances of the Chief Minister, Ministers and State Legislators.

Here’s a look at those two bills and the salaries and benefits that chief ministers and MPs earn across the country.

The new laws of Karnataka

Ahead of the state budget, the Karnataka Assembly on Tuesday passed bills proposing a 50% increase in the salaries and other allowances of the chief minister, ministers and legislators, as well as the president and chairman of the advice.

The new hike will come into effect on April 1, 2022. The bills also propose to automatically raise the salary once every five years.

The legislations also proposed increased allowances, for members’ homes, travel and telephone bills.

Under the new legislation, the Chief Minister will now receive Rs 75,000 per month as a basic salary, down from Rs 50,000 previously; while the salary of ministers increased from Rs 40,000 to Rs 60,000.

Apart from that, they are entitled to housing allowances of Rs 1.2 lakh {out of the existing Rs 80,000}, as well as Rs 20,000 for telephone bills, Rs 40,000 for constituency allowances, Rs 5,000 for postage and other expenses.

Law and Parliamentary Affairs Minister JC Madhuswamy was quoted by the news agency PTI saying that the increase was justified because wages and allowances had not increased since 2015.

“Diesel and petrol prices have increased exponentially, the medical allowance is low and the rent for houses has increased. In view of all this, we have decided to increase the existing amount in all these scales,” he said.

How are the salaries of Chief Ministers and MPs set?

The passage of the bills in the Karnataka Legislative Assembly sheds light on the allowances of Chief Ministers and MPs across the country.

Notably, the salaries of chief ministers are different in each state. Article 164(5) of the Constitution of India states that “Salaries and allowances of Ministers shall be such as the State Legislature may from time to time by law determine and, until the Legislature of the State so decides, shall be as specified in Schedule II The State’s Attorney General.

This means that each state decides what salaries their deputies, ministers and prime minister receive.

According to reports published in 2020, K Chandrashekar Rao, the Chief Minister of Telangana is the highest paid with a monthly salary of Rs 4.10 lakh.

According to reports, the total salary received by Delhi Chief Minister Arvind Kejriwal is Rs 3.9 lakh per month. In August 2021, the government of Arvind Kejriwal approved a cap on increases recommended by the Centre, which pushed the salary of Delhi MPs to Rs 90,000 per month – an increase from Rs 53,000.

Meanwhile, Udhav Thackarey from Maharashtra earns Rs 3.4 lakh every month.

Other reports state that Yogi Adityanath from Uttar Pradesh receives a monthly salary of Rs 3.65 lakh and allowances.

Prime Minister’s and President’s allowance

Apart from Chief Ministers and MPs, the President of India and Prime Minister also receive a salary.

President Ram Nath Kovind receives his salary under a law called the President’s Achievement and Pension Act, 1951.

In 2018, the Chairman’s salary increased from Rs 1,50,000 to Rs 5,00,000 per month. Apart from this, it enjoys facilities such as accommodation, trains, train and air travel, security, telephone, medical care and insurance in the 340-room Rashtrapati Bhavan at the expense of the government.

After retirement, a pension equal to 50% of the position’s then salary and numerous facilities are available for life. These include housing at government expense, a vehicle, two phones, a cell phone, health services, and free travel anywhere in the highest class with one person.

Prime Minister Narendra Modi’s salary is decided by Parliament in accordance with Article 75 of the Indian Constitution. Apart from a monthly salary of Rs 2 lakh, the Prime Minister also receives several other benefits including residence in the capital Delhi, Boeing 777-300ERs with IAF pilots, special security and much more.
